Nevada legalized sports betting in 1949 alongside reside and off-track horse gambling. It was the first nation to govern sports betting, which had previously operated under organized crime syndicates. It was also the only state to do so until recently.
Congress passed the skilled and Amateur Sports Protection Act (PASPA) in 1992, which illegal future state growth of sports gambling. Nevada was grandfathered in, so it was essentially handed a lawful US monopoly on single-game wagering.
States eventually began to challenge that federal ban, however, spearheaded by New Jersey lawmakers and Gov. Chris Christie. Beginning with voter approval in 2011, NJ attempted to pass legislation that would have legalized sports betting at casinos and racetracks. Sports leagues — the NBA, NCAA, NFL, NHL, and MLB — filed suit against the state to block the attempts, however, citing a violation of PASPA.
The ensuing legal battle escalated all the way into the US Supreme Court, finally reaching a resolution on May 14, 2018. The vast majority of the nine-member court ruled the PASPA commandeers nations in breach of the Tenth Amendment, striking the ban in the books.
Because of this, Nevada’s US monopoly online sports betting has seen its final days. Eight other states offer a wide choice of legal sports stakes.
